I looked up statutory rape laws by US states. I found it interesting. 30 states have set the age of consent at 16. The age gap plays a part in the severity of the crime involving sex with a minor. A smaller age gap (3-4 years) between consenting minors may not constitute a crime in some states. A larger gap, involving a minor and an adult, are often prosecuted as felonies.
I went to middle school, high school, and college in Arizona. The age of consent in AZ is 18. If a 16 year old and 18 year old have sex, it’s not considered statutory rape as long as the gap in age is no larger than 2 years. But, if a 19 year old has sex with a 16 year old, it’s rape, regardless if it was consensual. Yet, this would be perfectly legal in 30 states, as long as it was consensual.
My older sister ran off with a 30 something married guy in Arizona when she was 16. They went on a road trip together. They were caught days later by Arizona State Troopers. The married guy could have been facing serious jail time if charges were filed. My Dad decided not to press charges after talking to my sister about it. She was a willing participant.
I wondered if the guy’s wife took him back. Most likely that ended their marriage.
